The judge in the Gen. Flynn case has sat on the case for days past the DOJ dropping the charges against the General. However, yesterday, instead of doing the right thing, Judge Emmet Sullivan, who has allowed his personal animus to Flynn fly in his courtroom over these last couple years, has shoved the case fully under both cheeks of his ass now but, get this, allowing outside anti-Flynn forces to now insinuate their own “friend of the court briefs” hostilities into his decision on whether or not to drop the court case. That is what his ‘delay’ is based in, and he has invited these people to interlope in the Flynn case. Mind you, this same judge would not allow, on multiple occasions, outside evidence that would have been in Flynn’s favor during the trial. This group of ‘lawyers is known as the Watergate lawyers’. That should tell you a lot.
Former U.S. Attorney Brett Tolman thought he had “seen everything” over the course of his career until a federal judge opened the door Tuesday for legal experts and other outside parties to oppose the Justice Department’s motion to drop the case against former national security adviser Michael Flynn.
Appearing on “Fox & Friends,” Tolman said he believed Judge Emmet Sullivan’s decision was “outrageous” and that the Washington D.C. judge had turned himself into an “activist,” willing to set aside rules, ethics, and precedent in favor of partisanship.
Although Sullivan did not directly address the Justice Department’s motion to drop the charge against Flynn, in his order Sullivan announced he would set a schedule for outside parties to present arguments about the government’s request to dismiss the case….
Tolman told host Brian Kilmeade that while the court is going against its own rulings – which he labeled “sacrosanct” – Flynn’s attorney Sidney Powell is now “going to have to do some quick-acting” on her client’s behalf.
“She may file for example a writ of mandamus. That would allow her to immediately appeal this decision and this approach by this judge to the circuit,” he remarked.
“And let’s face it, if it looks like this is what’s going on, there is strategy then that’s at the heart of what this judge is trying to accomplish. And, that strategy is offensive to anyone who practices,” he stated. “It’s the United States against Michael Flynn. And, when the United States says we’re no longer going to pursue it because we don’t have the evidence, then the audacity of somebody outside of that coming in who has no authority is outrageous.”…

Most likely interpretation is he’s threading the needle of not wanting to rule on Powell’s motion to strike / block amici, by claiming he hasn’t entered a scheduling order yet

Then when Sullivan does enter that scheduling order, he’ll allow the watergate amicus brief, *without* having to rule on Powell’s motion first
Because he knows Powell’s motion quotes his own words back at him – that the Flynn criminal case docket is not the right place for amici

It’s a sure sign of desperation whenever lawyers try to raise President Richard Milhous Nixon from the dead.
And so it is that a group of former Watergate special prosecutors this week resurrected the Ghost of Watergate Past in a last-ditch effort to keep alive the federal court case against former National Security Adviser Michael Flynn.
The gang, adopting the sobriquet “Watergate Prosecutors,” asked permission from U.S. District Judge Emmet Sullivan to allow them to intervene in the Flynn case so they can – to put it bluntly – tell his honor how to think and what to do.
The judge issued an order Tuesday indicating he will soon accept “amicus curiae” (“friend of the court”) submissions in the case.
But in trial court proceedings involving crimes, only prosecutors and defense attorneys are permitted to be heard. Judges are supposed to render decisions based on evidence and arguments presented by the parties involved, not outside interests….
The former Watergate prosecutors now want to meddle in the Flynn proceedings like uninvited house guests. In a court filing, they compare Barr’s decision to drop the Flynn charge to “the Watergate scandal” and Nixon’s infamous “Saturday Night Massacre.” The analogy is as tortured as the late President Nixon’s soul.
Reading their “Statement of Interest” is a nauseating exercise in the hubris of war stories retold by old warriors prone to embellish. The former Watergate prosecutors imagine themselves as heroes who single-handedly salvaged democracy from the clutches of the demented Nixon. On that basis, they argue to the court, they are back to save the day.
I’m reminded of what Butch kept asking Sundance: “Who are those guys?” Good question….
